Hospitality Workers’ Rights Lawyer
Hospitality workers include workers in lodging, food and drink service, including restaurants and bars, event planning, theme parks, and even transportation. You have been working a banquet all day. You’re tired. Your feet are sore. You have heard at least 5 complaints about the fish, as if you could do something about it. At this point, you just want to get home. You’re a hospitality worker. And just because the customer is always right, doesn’t mean you don’t have rights.
Harassment and Discrimination in Hospitality
Like most California employees, California hospitality workers have the right to be free from harassment and discrimination in the workplace based off some personal characteristic like age, or race, or religion, or gender, or sex, or disability. They also have the right to be free from unlawful retaliation based off complaints of illegal activity or unsafe working conditions. They have the right to workers’ compensation if they get hurt on the job.
Minimum Wage, Overtime, and Meal and Rest Periods for Hospitality Workers
They also have the right to at least minimum wage for all hours worked. They have the right to a pain 10-minute rest period for every 4 hours worked. They have the right to an unpaid 30-minute meal period for every 5 hours worked. They have the right to be paid at least 1.5 times their regular rate (time and a half) for all hours worked over 8 in a day, or 40 in a week. They have the right to be paid at least 2 times their regular rate (double time) for all hours worked over 12 in a day.
